We reserve the right to decline any service request at our discretion, including but not limited to requests outside our service area or scope of work.
Written estimates provided by La Mesa Deck and Fence are valid for 30 days from the date issued unless otherwise noted. An estimate is not a binding contract until both parties have signed a written project agreement.
Prices may change if the scope of work changes, if site conditions differ materially from what was observed during the estimate visit, or if material costs increase significantly between estimate and project start. Any change in scope or price will be communicated to the customer in writing before additional work is performed.
Free on-site estimates are provided at no charge and with no obligation to proceed. Requesting an estimate does not create a contractual relationship.
Project start dates are estimates and subject to change based on weather, material availability, permit timelines, or prior project delays. We will communicate schedule changes as early as possible.
If you need to cancel or reschedule a project, please notify us as soon as possible. Cancellation policies specific to your project (including any deposit implications) will be stated in your written project agreement.
We reserve the right to suspend or terminate a project if site conditions are unsafe, if required permits cannot be obtained, or if payment obligations are not met.
Payment terms are specified in the written project agreement for each job. A deposit may be required before project work begins. Final payment is due upon substantial completion of the project unless otherwise agreed in writing.
Accepted payment methods will be outlined in your project agreement. Payments not received by the due date may result in work stoppage and may accrue late fees as specified in the agreement.
Disputes about invoiced amounts must be raised in writing within 10 days of the invoice date.
Where required by local ordinance, La Mesa Deck and Fence will apply for the necessary building permits on your behalf, with permit fees typically passed through to the customer as a line item in the project agreement. The customer is responsible for ensuring that the property is accessible and that any homeowners association (HOA) approvals required have been obtained prior to the project start date.
La Mesa Deck and Fence warrants its workmanship against defects in construction for a period stated in the written project agreement. This warranty covers labor and methods of construction but does not cover damage caused by improper use, weather events, normal wear and tear, or modifications made by anyone other than La Mesa Deck and Fence.
Material warranties, if any, are provided by the respective manufacturers and are subject to those manufacturers' terms. We will assist customers in filing manufacturer warranty claims where applicable.
To the maximum extent permitted by applicable law, La Mesa Deck and Fence shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use of our website or the services we provide, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of a specific project shall not exceed the total amount paid by the customer for that project.
